O caso começou a ser analisado em agosto de 2024 e já foi suspenso duas vezes por pedidos de vista.

Na semana passada, Denarium renunciou ao cargo para disputar uma vaga ao Senado nas eleições de outubro, conforme determina o prazo de desincompatibilização definido pela legislação eleitoral.

Com a saída, Damião, que era vice-governador, assumiu o comando do governo estadual.

Até o momento, o placar do julgamento está 2 votos a 0 pela cassação da chapa. Os votos foram proferidos pela relatora, Maria Isabel Galotti, que já deixou o tribunal, e o ministro André Mendonça. Faltam os votos de cinco ministros.

Se a maioria dos ministros mantiver o entendimento, o TSE poderá determinar novas eleições para mandato-tampão de governador do estado.

Acusação

O TSE julga um recurso protocolado pela defesa do governador. Em 2023, o Tribunal Regional Eleitoral de Roraima (TRE-RR) cassou o mandato de Denarium e de seu vice por entender que houve ilegalidade na distribuição de cestas básicas e benefícios para reforma de casas durante o ano eleitoral.

Em agosto de 2024, a relatora votou pela cassação do governador.

Em novembro do ano passado, André Mendonça também votou pela cassação da chapa.

Após o voto, Nunes Marques pediu vista e interrompeu a análise do caso. Marques será o próximo a votar.

Defesa

Durante a tramitação do processo, a defesa do governador pediu a anulação da decisão que cassou o mandato e disse que não houve irregularidades na distribuição dos benefícios. Segundo os advogados, não houve a criação de novos programas sociais, mas a reunião dos já existentes.
